Article 85-Capital and Currency Requests |
|
| 85.1 |
Capital Allocated to Accounts |
|
| |
Consistent with its obligations and formation, the Bank holds in trust an amount of Capital Stock named for the benefit of certain nations, states, entities and individuals. |
|
| |
However, the procedure for releasing Capital by the Bank to the name beneficiary is dependent upon the standards of procedures and rules outlined in this Charter. |
|
| |
A request for Capital or Currency must be valid according to this Article and Charter before being permitted to be processed by the Bank. The submission of a false or misleading request, or the processing of an invalid request shall both be considered Criminal Offences subject to penalties prescribed under the Criminal Code of the Union. |

Valid Request for Capital or Currency |

The Bank shall process all valid requests for Capital or Currency in a timely manner subject to the conditions and rules set forth in this Charter. The primary conditions of a valid request for Capital or Currency shall be: |
|
| |
(i) That the man or woman making the request has been validated as representing themselves correctly; and |
|
| |
(ii) That a correct account exists to which the request relates and for which the man or woman making the request has authority to make such a request; and |
|
| |
(iii) That the request has been validated by a Court of Law or through the Judicial Powers of the Bank through due process of law and service of appropriate forms and documents; and |
|
| |
(iv) That the purpose and amount of the request are consistent with the authorities of making such a request; and |
|
| |
(v) That the Bank Officers processing the request have the authority to approve and process the request. |
|
| |
When these five criteria are met, a request shall be valid. |

Invalid Requests for Funds |
|

The Bank is hereby legally obliged to refuse any and all direct requests for Funds made to it by any men, women or corporation not presently representing an official arm of government. All such requests for Funds must be lodged by the appropriate government of the free society and superior court of a free society on behalf of the men or woman.

Therefore, all direct requests for funds shall be refused ab initio (from the beginning) of the request being sent. The Bank reserves the right to pursue legal action against any men or women who refuse to acknowledge due process and continue to write directly to the Bank requesting funds, ignoring the legal restrictions placed upon the Bank.

| |
In respect of non-Member societies, the Bank may choose to accept or deny an unsolicited request for Funds, providing the government, or government agency meets the legal requirements of a valid request to the Bank Charter and procedures to qualify for such assistance.
